These terms apply when you buy from mirayama.co.uk as a consumer. Please read them with our Shipping Policy, Refund Policy and Privacy Policy. Nothing in these terms affects your statutory rights.
1. Who we are
This website is run by Mirayama Limited, a company registered in England and Wales under company number 14102867. Our registered office is 21 Brooksville Avenue, London NW6 6TH, United Kingdom. Our VAT number is GB413122063. You can contact us at contact@mirayama.co.uk. "We", "us" and "Mirayama" mean Mirayama Limited.
2. Using our website
You must be at least 18 years old to place an order. Please use the website lawfully and do not try to interfere with how it works or to copy its content for commercial use.
3. Our pieces
Our pieces are made by hand, so small variations in tone, texture and finish are part of each piece and are not faults. Colours can look slightly different on screen. Composition and care details are given on each product page. If you would like advice before ordering, please write to us.
4. How a contract is formed
When you place an order, we will email you to acknowledge it. This does not mean your order has been accepted. Our contract with you begins when we email to confirm that your piece has been dispatched or, for made-to-order and couture pieces, when we email to confirm your order and its expected dispatch date.
If we cannot accept your order, for example because a piece is no longer available or there is an error in the price or description, we will tell you and will not charge you. If you have already paid, we will refund you in full.
Before you submit your order, you can review and correct its details at checkout.
5. Prices and payment
Prices are shown in pounds sterling (GBP) and include VAT for delivery in the United Kingdom. If you shop from outside the UK, prices may be shown in your local currency. Delivery charges are shown at checkout before you pay. For orders delivered outside the UK, import duties and local taxes may be payable on delivery, as explained in our Shipping Policy.
We accept the payment methods shown at checkout. Payment is taken when you place your order. For couture pieces commissioned by appointment, we will agree the price and payment terms with you in writing before work begins.
If we find an obvious error in the price of a piece you have ordered, we will contact you before dispatch. You may then go ahead at the correct price or cancel for a full refund.
6. Availability and made-to-order pieces
Many of our pieces are made in small numbers, so availability is limited. Some pieces are made for you after you order. We will email you to confirm the expected dispatch date once your order has been placed.
Create Your Own ponchos and couture capes commissioned by appointment are made to your specifications. Before we begin, we will confirm the design, price and expected timing with you in writing.
7. Delivery and risk
Delivery options, costs and times are set out in our Shipping Policy. Your piece is our responsibility until it is delivered to you or to someone you have nominated. Ownership passes to you on delivery, provided we have received payment in full.
Unless we agree another date with you, we will deliver within 30 days of the contract being made. If we are delayed by events outside our control, we will let you know as soon as possible and do what we can to reduce the delay. If the delay is likely to be substantial, you may cancel and receive a full refund for anything you have paid for but not received.
8. Your right to cancel
You may cancel most online orders within 14 days of receiving your piece, without giving a reason. Pieces made to your specifications or clearly personalised cannot be cancelled once we have started making them. Full details, including how to cancel and how refunds work, are in our Refund Policy.
9. If something is wrong with your piece
We are under a legal duty to supply pieces that are of satisfactory quality, fit for purpose and as described. If a piece is faulty or not as described, you have rights under the Consumer Rights Act 2015, including a 30-day right to reject and, after that, the right to a repair or replacement. 10. Our responsibility to you
If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or of our failure to use reasonable care and skill. Loss or damage is foreseeable if it is obvious that it will happen, or if both we and you knew it might happen when the contract was made.
We supply our pieces for private use only. We are not responsible for any loss of profit, loss of business or business interruption.
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for breach of your statutory rights as a consumer.
11. Intellectual property
All designs, photographs, text, logos and other content on this website belong to Mirayama Limited or are used with permission. You may view and share them for personal, non-commercial purposes, but you may not copy, reproduce or use them commercially without our written permission.
12. Your personal information
We use your personal information as set out in our Privacy Policy.
13. Questions and complaints
If you have a question or a complaint, please email contact@mirayama.co.uk. We will reply as soon as we can and aim to resolve every concern personally.
14. Law and courts
These terms are governed by the law of England and Wales. You may bring legal proceedings in the courts of England and Wales. If you live in Scotland, you may bring proceedings in Scotland or England and Wales. If you live in Northern Ireland, you may bring proceedings in Northern Ireland or England and Wales.
15. Other important terms
If a court finds part of these terms unlawful, the rest will continue in force. If we do not enforce a right straight away, we may still enforce it later. This contract is between you and us, and no one else has any rights to enforce it.
16. Changes to these terms
We may update these terms from time to time. The terms that apply to your order are those shown on this website when you placed it.
